Terms and Conditions


Welcome to Joganiya Car Courier Services Private Limited ("Joganiya Car Courier Services", "we", "our", or "us"). By using our goods transportation services ("Services"), you ("Customer", "you", "your") agree to be bound by these Terms and Conditions ("Terms"). Please read them carefully before using our Services.

1. Acceptance of Terms

By booking or using any services provided by Joganiya Car Courier Services, you agree to comply with and be legally bound by these Terms. If you do not agree to these Terms, you must refrain from using our services.

2. Description of Services

Joganiya Car Courier Services provides transportation of goods across various locations within India. Our services include but are not limited to:

  • Transporting goods via road, including local, intercity, and interstate deliveries.
  • Providing door-to-door delivery of goods.
  • Packaging services (if applicable).
  • Tracking and monitoring of shipments.
  • Custom solutions for bulk or special cargo (upon request).

3. Customer Obligations

  • Accurate Information: The customer must provide accurate details about the goods being transported, including but not limited to weight, dimensions, type of goods, and destination.
  • Prohibited Items: Customers must not send goods that are illegal, hazardous, perishable, or dangerous under Indian law. This includes but is not limited to:
    • Explosives, flammable items, firearms, or illegal substances.
    • Perishable goods requiring refrigeration (unless specifically agreed upon).
    • Live animals or pets (unless explicitly agreed).
  • Proper Packaging: The customer is responsible for ensuring that the goods are properly packed for transit. Joganiya Car Courier Services is not responsible for any damages due to improper packaging.
  • Delivery Instructions: The customer is responsible for providing accurate and clear delivery instructions, including addresses and contact details for both the sender and receiver.

4. Payment Terms

  • Charges: Charges for the transportation of goods will be based on factors such as weight, size, destination, and any additional services requested by the customer. A detailed quote will be provided before booking.
  • Payment Methods: Payment is due at the time of booking, unless otherwise agreed. Accepted payment methods include bank transfer, credit/debit cards, and online payment gateways. All payments must be made in INR (Indian Rupees).
  • Refunds: Refunds for cancellations will be provided as per the cancellation policy (see Section 7).

5. Delivery and Transit Times

  • Estimated Delivery Time: While we aim to deliver goods within the estimated time frame, delivery times are estimates and not guaranteed. We are not liable for delays due to unforeseen circumstances such as weather conditions, road closures, or other events beyond our control.
  • Tracking: Customers will be provided with tracking information to monitor the progress of their goods. However, we are not liable for any delays or loss of tracking data.

6. Liability and Claims

  • Damaged Goods: If goods are damaged during transit, the customer must inform Joganiya Car Courier Services within 24 hours of delivery to file a claim. Damages caused by inadequate packaging or prohibited items will not be eligible for claims.
  • Lost Goods: In the event that goods are lost or misplaced during transit, Joganiya Car Courier Services will investigate the matter and, where applicable, offer compensation based on the value of the goods, subject to the terms of the insurance coverage (if purchased). However, we are not liable for any indirect or consequential losses arising from the loss of goods.
  • Force Majeure: We are not liable for any delays or failures in performance due to events beyond our control, including but not limited to natural disasters, acts of terrorism, labor strikes, or government restrictions.

7. Cancellation, Refund and Return Policy

Cancellation:

  • Customers may cancel their bookings up to 24 hours before the scheduled pickup. Cancellations made after this time may incur a cancellation fee as outlined below: 
    • Before 24 hours: Full refund of the booking amount (excluding any non-refundable third-party fees).
    • Within 24 hours: 50% of the booking amount will be refunded (excluding third-party fees).
    • After pickup has been initiated: No refunds will be issued.

Refunds:

  • Refunds will be processed within 1-2 business days from the date of cancellation confirmation.
  • Refunds will be credited to the original payment method used during booking.
  • Any fees or charges levied by third-party payment gateways or banks will not be refunded.

           Special Cases:

  • If a service failure occurs due to circumstances attributable to Joganiya Car Courier Services (e.g., failure to pick up goods without valid reason or unjustified service cancellation), a full refund of the booking amount will be issued.
  • If services are disrupted due to force majeure events (e.g., natural disasters, government restrictions), refunds will be issued on a case-by-case basis, depending on the nature of the disruption.

Return Policy:

  • In cases where goods cannot be delivered to the recipient due to reasons beyond our control (e.g., incorrect address, recipient unavailable, refusal to accept delivery), the following options are available:
    1. Return to Sender:
      • The goods will be returned to the sender at the sender's cost. The return shipping charges will be calculated based on the original shipment details and must be paid by the customer before initiating the return.
    2. Hold at Destination:
      • The goods may be held at our nearest facility for up to 7 days while awaiting updated delivery instructions. Additional holding fees may apply.
  • Joganiya Car Courier Services is not responsible for goods left unclaimed for more than 7 days. Unclaimed goods may be disposed of, and no compensation or refund will be provided in such cases.

8. Insurance

Insurance Options: We offer optional insurance for goods during transit, covering potential damage or loss. The customer is encouraged to opt for insurance to safeguard their goods. Insurance coverage is limited to the declared value of the goods and subject to the terms of the insurance provider.

9. Indemnity

The customer agrees to indemnify and hold harmless Joganiya Car Courier Services, its employees, directors, and agents from any claims, losses, damages, or expenses arising from the customer’s violation of these Terms, including but not limited to:

  • Misrepresentation of the goods being transported.
  • Failure to provide accurate delivery details.
  • Sending prohibited or dangerous goods.
  • Breach of applicable laws or regulations.

10. Modification of Terms

Joganiya Car Courier Services reserves the right to update or modify these Terms at any time. Any changes will be posted on our website or communicated to the customer. By continuing to use our services after any modifications, the customer agrees to be bound by the updated Terms.
